The Romanian legislation on WEEE includes the following:
Directive 2002/96/EC has been transposed through the Government Decision 448/2005 on waste electrical and electronic equipment;
Order 901/2005 on the approval of the specific measures for the collection of WEEE posing risks of contamination for the security and health of the collection point personnel;
Order no.1223/715/2005 on the approval of the manufacturer registration procedure, means of recording and reporting data on electrical and electronic equipment and waste electrical and electronic equipment;
Order 1225/721/2005 on the approval of the Procedure and criteria for the evaluation and authorization of collective organizations with a view to taking-over the responsibility regarding the annual targets of WEEE collection, reuse, recycling, and recovery.
Order 556/2006 on the specific marking attached to electrical and electronic equipment placed on the market after December 31, 2006.
Government Decision 448/2005 on waste electrical and electronic equipment. Pursuant to this decision, the main actors responsible for attaining WEEE collection, treatment, recovery and non-pollutant disposal targets are local public authorities, electrical and electronic equipment manufacturers, and consumers. Other authorities that support the attainment of such targets are: the Ministry of Environment and Sustainable Development, the Ministry of Economy and Commerce, the National Environmental Protection Agency, the National Environmental Squad.
Order no. 1223/715/2005 on the approval of the manufacturer registration procedure, means of recording and reporting data on electrical and electronic equipment and waste electrical and electronic equipment is a subsequent order to the Government Decision 448/2005 and is common with the Ministry of Economy and Commerce;
Order 1225/721/2005 refers to approval of the Procedure and criteria for the evaluation and authorization of collective organizations with a view to taking-over the responsibility regarding the annual targets of WEEE collection, reuse, recycling, and recovery;
Order 556/2006 the specific marking attached to electrical and electronic equipment placed on the market after December 31, 2006.
Role of the Ministry of Environment and Sustainable Development and of the Ministry of Economy and Commerce:
- To organize public information and awareness raising campaigns;
- To organize working groups with concerned factors;
- To manage all actions with a view to implementing directive targets;
- To draw up Bruxelles reports;
- To guide manufacturers in accessing investment funds;
- To conduct research studies.
Role of the National Environmental Protection Agency:
- To register manufacturers;
- To authorize collective organizations;
- To implement the targets set by the Government Decision 448/2005 on waste electrical and electronic equipment;
Role of the National Environmental Squad and of the National Authority for Consumer Protection:
- To inspect and control the enforcement of the Government Decision 448/2005.
Role of the Local Public Administration:
- Selective collection of WEEE from private households;
- To make available for manufacturers the spaces required to establish collection points;
- To ensure the functionality of collection points.
